**Terms & Conditions for using DocScan.in**

Welcome to DocScan.in (“Platform”), owned and operated by DocScan.in (“Company”, “We”, “Us”).
By accessing, subscribing, or using any service on DocScan.in, you agree to these Terms & Conditions (“Terms”).
If you do not agree, please do not use the Platform.
- Definitions
- “Platform” – The website www.docscan.in and all associated services such as passport scanning, OCR, ID scanning, secure storage, and reporting.
- “User/Subscriber/You” – Any individual or organization using or purchasing the services.
- “Data” – Documents, images, IDs, passport details, and any personal or sensitive data uploaded by the User.
- Acceptance of Terms
By creating an account or subscribing to DocScan.in services, the User agrees to:
- Be bound by these Terms.
- Ensure lawful use of data and documents uploaded.
- Use the Platform only for permitted and legal activities.
- Services Provided
DocScan.in provides:
- Passport & ID scanning
- OCR-based data extraction
- Cloud storage for uploaded files
- Excel/report generation
- Dashboard and API access (if applicable)
- Customer support
The Company may add, modify, or discontinue features with reasonable notice.
- Eligibility
Users must:
- Be at least 18 years of age.
- Represent a valid individual, agency, or business entity.
- Use the Platform only for legitimate and lawful purposes.
- Account Registration
Users must:
- Provide accurate registration information.
- Maintain confidentiality of login credentials.
- Take responsibility for all activities under their account.
The Company may suspend accounts in case of suspicious or unlawful activity.
- Subscription Plans & Payments
- All services are subscription-based with fees payable in advance.
- Once paid, fees are non-refundable, unless otherwise stated.
- The Company reserves the right to revise pricing with prior notice.
- Paid features will be accessible only during the active subscription period.
- User Responsibilities
You agree not to:
- Upload illegal, forged, or unauthorized documents.
- Misuse the Platform for data scraping, duplication, or reverse engineering.
- Use the Platform to process data without proper permission from your clients/customers.
- Attempt unauthorized access into the Platform’s systems.
- Compliance With DPDP Act 2023 (Digital Personal Data Protection Act)
8.1 Roles Under the DPDP Act
- You (User/Agency) act as the Data Fiduciary for personal data collected from your customers.
- DocScan.in acts as the Data Processor strictly for document scanning and processing.
8.2 DocScan.in Obligations
DocScan.in will:
- Process personal data only based on written or electronic instructions from the User.
- Maintain reasonable security safeguards to prevent data breaches.
- Not disclose, sell, or share personal data with third parties.
- Notify the User of any data breach within a reasonable time.
- Retain data only as long as necessary for service delivery.
8.3 User Obligations (Data Fiduciary)
The User must:
- Obtain valid consent from customers before uploading their documents.
- Provide rights to data principals (access, correction, erasure) as required by DPDP Act.
- Ensure accuracy and lawful purpose of data collected.
- Appoint a grievance contact (if required by law for your entity size).
8.4 Cross-Border Data Transfer
If any processing occurs outside India, it will be done in accordance with DPDP Act requirements.
- Data Storage & Retention
- Uploaded documents may be stored on secure servers within or outside India.
- Users may request deletion of uploaded data.
- Deleted data may remain in backup servers for a limited period as per retention policy.
- Confidentiality
Both parties agree to maintain strict confidentiality of:
- Uploaded documents
- Extracted data
- Business information
Except where required by law or for service delivery.
- Intellectual Property
- The Platform, software, design, UI/UX, algorithms, and branding are the exclusive property of the Company.
- Users receive a non-transferable license to use the Platform during their subscription.
- Reproduction, modification, or resale of software/services is prohibited.
- Service Availability
- The Company aims for 99% uptime but does not guarantee uninterrupted service.
- Planned maintenance will be notified whenever possible.
- The Company is not responsible for disruptions caused by third-party hosting providers, internet failures, or user-side issues.
- Limitation of Liability
To the maximum extent permitted by Indian law:
- The Company is not liable for losses arising from incorrect or illegal data uploaded by Users.
- The Company is not responsible for indirect, incidental, or consequential damages.
- Total liability is limited to the subscription amount paid in the previous three months.
- Termination
The Company may suspend or terminate access if:
- The User violates any law or term.
- Account misuse or unauthorized activity is detected.
Upon termination:
- User access is removed.
- Data may be deleted as per retention rules.
- Governing Law & Jurisdiction
This Agreement shall be governed by the laws of India.
All disputes, claims, or legal proceedings shall be exclusively subject to the jurisdiction of the courts at Ahmedabad, Gujarat.
- Amendments
The Company may update these Terms periodically. Continued usage of the Platform constitutes acceptance of revised Terms.
