SUBSCRIBER AGREEMENT

This Subscriber Agreement (“Agreement”) is entered into between DocScan.in, owned and operated by Docscan.in Ahmedabad (“Service Provider”), and the Subscriber (“User”, “You”), who accesses or uses the online document scanning, storage, and data extraction services available on www.docscan.in (“Platform”).

By subscribing to or using the Platform, you agree to be bound by this Agreement.

1. Definitions

1. Platform – Refers to the website DocScan.in and all associated services including passport scanning, ID scanning, OCR processing, cloud storage, and reporting.
2. Subscriber/User – Any individual or entity that purchases, registers for, or accesses the services.
3. Data – Includes documents, images, passport information, ID proofs, and any personal or sensitive personal data uploaded by the User.

1. Scope of Services

DocScan.in provides:

• Online passport & ID scanning
• OCR-based data extraction
• Secure cloud storage
• Excel/CSV reports
• API or dashboard access
• Visa form filling service
• Customer support

Services may be updated or improved from time to time.

1. Subscriber Responsibilities

The Subscriber agrees to:

• Provide accurate registration and billing information.
• Use the Platform only for lawful purposes.
• Ensure that documents uploaded are legally obtained from their customers.
• Not misuse, copy, reverse-engineer, or resell the services unless authorised.

1. Subscription Fees & Payment Terms

• Subscription fees are payable in advance as per the plan selected.
• Payments once made are non-refundable unless otherwise specified.
• The Service Provider may revise pricing with prior notice.

1. Data Privacy & FPDP/DPDP Act 2023 Compliance

The parties agree to comply with the Digital Personal Data Protection Act, 2023 (DPDP Act 2023) of India.

5.1 Role of Parties

• The Subscriber acts as the Data Fiduciary for personal data collected from their customers.
• DocScan.in acts as the Data Processor strictly for providing scanning and data extraction services.

5.2 Obligations of DocScan.in (Data Processor)

DocScan.in shall:

• Process personal data only on the instructions of the Subscriber.
• Implement reasonable technical and organisational security measures to protect personal data.
• Not retain personal data longer than necessary for delivering services.
• Not disclose, share, or sell personal data to any third party without explicit instructions.
• Notify the Subscriber of any personal data breach without undue delay.

5.3 Obligations of Subscriber (Data Fiduciary)

The Subscriber shall:

• Obtain lawful consent from their customers before uploading their documents.
• Ensure accuracy and purpose limitation of data collected.
• Comply with user rights such as data access, correction, deletion, and grievance redressal.

5.4 Cross-Border Data Transfer

If data is transferred outside India for processing, it shall comply with applicable provisions under the DPDP Act 2023.

1. Confidentiality

All data, business information, and documents exchanged under this Agreement shall remain confidential and shall not be disclosed except for providing the services or where legally required.

1. Intellectual Property Rights

All software, UI/UX, trademarks, algorithms, dashboards, and code on DocScan.in remain the exclusive property of the Service Provider.
Subscribers are granted non-exclusive, non-transferable access during their subscription period.

1. Service Availability & Limitation of Liability

• DocScan.in aims for 99% uptime but does not guarantee uninterrupted access.
• The Service Provider shall not be liable for:
  • Loss of profits
  • Business interruption
  • Wrong or incomplete data uploaded by the User
  • Indirect or consequential damages

Liability is limited to the subscription amount paid in the preceding 3 months.

1. Term & Termination

• Either party may terminate this Agreement with 7 days’ notice.
• Immediate termination may occur if:
  • User violates laws or this Agreement
  • User misuses the Platform

Upon termination, User data may be deleted as per the data retention policy.

1. Governing Law & Jurisdiction

This Agreement shall be governed by the laws of India.
Any dispute, claim, or legal proceeding shall be subject to the exclusive jurisdiction of the courts at Ahmedabad, Gujarat.

1. Amendments

The Service Provider may modify this Agreement periodically, and continued use of the Platform shall constitute acceptance of the updated terms.
